What is Probate?
Probate is a court procedure by which the estate of a deceased person is administered and distributed to heirs and beneficiaries. It generally takes between 7-8 months to complete the probate process.
Alternatives to Hiring a Probate Attorney
There are a few ways to probate an estate without hiring a probate attorney.

- Another way to avoid probate is to transfer assets into a Trust. However, creating a Trust must be done prior to death because it enables the Trustee(s) to monitor and change their assets as needed. When a Trust has been established and an individual has put their assets in the trust, the Trust will enable the estate to avoid probate in California.
- When the value of an estate is $150,000 or less, there is a procedure commonly known as a Simplified Probate and can be settled without a formal probate proceeding. After an initial 40 day waiting period, heir(s), under intestate succession laws, may settle the estate and obtain title or possession of the property by completing a Small Estates Affidavit.
